Terms of sale
Plainly, and without the usual hedging. These terms apply when you buy an official copy of a title document through Homeproof. The free check has no terms beyond the privacy notice and the line on every page that it is not legal advice.
1. Who you are buying from
Phil Hurman, trading as Homeproof, a sole trader. Our address for correspondence is Bakersgate Cottage, Ash Road, Woking, Surrey GU24 0NA. Email hello@gethomeproof.co.uk. Homeproof is an independent service: the documents are HM Land Registry's, bought from them for you when you order.
2. What you buy
An official copy of the title register, the title plan, or a document the register refers to (a lease, a conveyance, a transfer, a charge), for one registered title in England or Wales, issued by HM Land Registry through their Business Gateway. It is delivered into your certificate on this site, read in and explained, and the official copy itself can be downloaded from there while you are signed in. Nothing is posted. Only documents HM Land Registry can send electronically are offered.
The price of each product is shown on the product's page and on the order page before you pay, and includes HM Land Registry's own fee for each copy and any VAT that applies. Nothing else is added at checkout.
- Register, plan & deeds: From £39.99
- Register & plan: £29.99
- Title register: £15.99
- Title plan: £15.99
- Lease or deed: £15.99
- Lease & register: £29.99
Verified estate agents and conveyancers whose firm is on the Trade plan pay the plan's price shown on their account while the plan is active, and through the week after a failed renewal. Firms with an account are also bound by the firm terms.
3. How an order is made
You run the free check on the address, open its order page, tick what you want and see the total. Anything ticked can be unticked, and the address can be changed by running another check, until you press Order. If you are not signed in, you also give the email address the certificate and documents should go to: check it before you press Order, and if it is wrong after that, do not pay, sign out and order again with the right address. Pressing Order takes you to Stripe's payment page, where the total is shown again before you pay. Once paid, the order is recorded in your account, where you can see it at any time, and a confirmation is emailed to you with these terms. The contract is in English. The copies arrive as PDF files, which open in any PDF reader; they are not locked to a device.
4. Before any money is taken
When you order, a free search with HM Land Registry first confirms that the address matches exactly one registered title. If it matches none, or more than one, nothing is charged and the page tells you so. If the free check already found the title, the order goes straight through. So if the title cannot be found, nothing is charged; and if something you have paid for then cannot be supplied, it is refunded in full (section 7). Between 11pm and 6.30am HM Land Registry's search service is closed, so the search cannot run before you pay: the order page tells you so, you may still order, we run the search the moment they reopen and buy your documents, and if it then finds no single registered title for the address your payment is refunded in full, automatically.
5. Paying, starting at once, and the right to cancel
Payment is taken by card through Stripe, who handle the card details; we never see them. By pressing Order you ask us to buy the official copies from HM Land Registry at once, without waiting for the fourteen-day cancellation period to run, and you accept that you lose the right to cancel a copy once it is in your certificate. This is the express request and acknowledgement the Consumer Contracts Regulations 2013 ask for. Until a copy is in your certificate you may still cancel it, by emailing us with the check link, and it is refunded in full.
6. How fast it arrives
HM Land Registry's Business Gateway takes applications between 6.30am and 11pm every day. In those hours an official copy is usually in your certificate within minutes of payment. An order placed overnight, or while their systems are down for maintenance, is collected when they reopen, and you are emailed when it arrives. Occasionally HM Land Registry refer a request to a person, which can take them a few working days, and the certificate says so while you wait. No time is guaranteed, because the last step is theirs.
7. If it cannot be delivered
If HM Land Registry cannot supply something you paid for, that item is refunded in full to the card you paid with; where an order has several items, the ones that arrived are kept and the rest refunded. If something has not arrived and the certificate does not explain why, email us with the check link and we will either deliver it by hand or refund it. If we ever supply documents for a different title from the one you ordered, we refund the order in full and remain responsible for the foreseeable loss that results. Refunds are made through Stripe and show on your statement within a few days.
8. What the documents are, and what you may do with them
Official copies are HM Land Registry's records; the mapping on a title plan is Ordnance Survey's. Both are Crown copyright, and we hold the licences needed to supply them to you inside your certificate. You may use them for your purchase, sale, mortgage or any legal matter about the property, and you may share your certificate's link with the people involved. You may not republish the copies on a public website, resell them, or copy the plan's mapping for any other purpose. A document shows the register as it stood at the date and time printed on it; HM Land Registry's register can change afterwards.
9. What the check is, and is not
The free check reads the public registers about an address and reports what they say, with the source and the date against every fact. It is a record of what was found, not legal advice, and it supports, rather than replaces, a buyer's conveyancing and an agent's own duties. A document that HM Land Registry say is held may still, when it arrives, not say what you hoped: the register summarises deeds, and the deeds say what they say.
10. Accounts
You can order with an email address alone: an account is made for it when you press Order, because the certificate and the delivery notice are sent to that address and the official copies sit behind a sign-in. The email we send carries a link that confirms the address and opens your certificate on any device, and your account page lets you choose a password for next time. One account per email address. You are responsible for keeping your sign-in to yourself; the official copies in your certificate name the owners of the property and their lenders, which is why they sit behind it.
11. Our responsibility to you
We are responsible for supplying what you ordered, as described here, with reasonable care and skill, and for loss that is a foreseeable result of our failing to do so. We are not responsible for the accuracy of HM Land Registry's register itself, which their own indemnity covers, or for business losses. The free check is not advice, and we are not responsible for decisions taken on it alone. Nothing in these terms limits your rights under the Consumer Rights Act 2015, or any liability that the law does not allow to be limited.
12. Complaints
Email hello@gethomeproof.co.uk with the check number (if you have one) and what went wrong. We will acknowledge your complaint within 5 working days of receiving it, and give you our full answer in writing within 20 working days wherever we can. If we need longer, we will tell you why and when to expect our answer. Someone acting for you, such as your conveyancer, may complain on your behalf if you tell us so. Complaints about messages, about papers or answers reported as illegal or harmful, and appeals against removed content or closed accounts follow the faster procedure at https://gethomeproof.co.uk/messaging#complaints. We are not members of an alternative dispute resolution scheme.
13. The rest
These terms, and any dispute about them, are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction (if you live in Scotland or Northern Ireland you may also bring a claim in your own courts). We may change these terms for future orders; the version in force when you ordered is the one that applies, this page carries its date, and your confirmation email names it. If a court finds any part unenforceable, the rest still stands.
