Homeproof firm terms

These terms are between Homeproof and a firm of estate agents or conveyancers that has an account with us. The person who creates the firm's account accepts them for the firm and for everyone the firm invites. Each person who joins the firm accepts them again when they join.

1. What the firm's account is for

The firm's members can run property checks, see and work on the checks the firm's members start, order official copies from HM Land Registry, and send sellers links to answer questions and upload their own papers. Official copies are paid for by card, one order at a time, when they are ordered.

2. Ordnance Survey data

Our checks and certificates use data from Ordnance Survey under our licence with them. The firm and its members may use that data only to view it and to use it within the firm's own business, for the property it was fetched for. Nobody at the firm may copy, sell, pass on or sublicense it, extract it in bulk, or use it to build or improve a commercial product or service.

Where a page shows Ordnance Survey premium data on screen, such as detailed building information or detailed map tiles, it is for viewing only. It is not to be printed, saved or copied except for a person's own non-commercial use.

Ordnance Survey may enforce this section directly against the firm, under the Contracts (Rights of Third Parties) Act 1999.

We keep a list of the firm's members (each member's name, the firm's name and the member's email address, and the dates they joined and left; someone who leaves stays on it for twelve months). We give it to Ordnance Survey only if Ordnance Survey asks for it.

3. HM Land Registry

Official copies are supplied by Homeproof from HM Land Registry, unaltered. We keep a record of which member ordered which title, and when, for seven years. Neither Homeproof nor the firm suggests any partnership with HM Land Registry or Ordnance Survey.

4. The firm's own legal work

Homeproof fetches and presents official copies and searches, reports and explains the data, and collects the seller's own answers and papers. It drafts no instrument relating to land and lodges nothing for registration. The firm keeps full responsibility for any reserved legal work, and for any advice it gives its clients. A certificate is prepared for the firm; it supports, and does not replace, the firm's own checks and duties.

5. The firm's members

The firm's owner and admins decide who is invited. The firm is responsible for how its members use their accounts. When someone leaves the firm, the checks they started for it, and everything bought for them, stay with the firm.

6. Payment and refunds

If the firm later takes a monthly plan, it is paid in advance, and no refund is given for part of a month.

7. Support

Support is by email to hello@gethomeproof.co.uk, answered within two working days. There is no telephone line, and no promise of uptime or turnaround beyond what the certificate pages say about HM Land Registry's opening hours. Planned maintenance is announced on this site.

8. Changes to these terms

A changed version of these terms has a new version date, and each person is asked to accept it again.
